Procedures for Purchasers W/O Prior Year Certificates of Delinquency

  • At least five (5) business days before the date of the tax sale, (July 19, 2012), each individual or entity seeking to participate in the sale shall register with the county clerk by presenting anon-refundable registration fee, certifiedcheck only. The registration fee is tiered startingat $10.00 per certificate of delinquency andcapping at a $250.00 fee. The registration fee iscapped but the number of bills eligible to bepurchased is not. (KRS 134.010, SEC 10 (h)).
  • Please complete the Acknowledgement ofParticipation Form before the July 14, 2011Delinquent Tax Bill Sale. This form is required toparticipate in the sale and will validate all billspurchased by 3rd party purchaser. The form is tobe turned in at the conclusion of the sale by each3rd party purchaser.
  • All individuals or entities seeking toparticipate in the tax sale shall register withthe Revenue Department prior to June 29,2011. Please click here and visit their websitefor further details.
  • A “PURCHASE INTENT LIST” OF BILLSMUST BE TURNED IN AT THE SAME TIMEAS PAYMENT.
  • Payment shall be made by certified check at thetime the list is submitted (25% of List Value mustbe submitted). An additional $50.00 filing fee isrequired for each certificate of delinquencypurchased. One certified check including bothamounts is allowable.
  • The purchaser’s information to be provided asfollows:o Purchaser’s Nameo Purchaser’s Mailing Address(physical and P.O. Box)o Purchaser’s Telephone Numbero If purchaser is an entity, the name ofthe contact person shall be provided
  • A potential purchaser shall also submit anaffidavit affirming that the purchaser is notrelated to any other individual or entity that willbe participating in the sale.
  • The following shall be considered related entities:
    • Members of the same family
    • Entities:
      • With Common Ownershipor Management
      • Having Been Formed byOne or More of the SameEntities
      • Having One or More of theSame Investors
      • Having One or More of theSame Directors,Members, Partners orOfficers
      • Having More than OneClient Registered for thatCounty’s Sale
  • At the same time a 3rd party purchaser registerswith the county clerk, the purchasers shallsubmit a “Purchase Intent List” of certificates ofdelinquency that he, she or it intends to purchase.The list shall be prepared in 2010 Tax BillNumber order as determined by the county clerkand shall include:o Tax Bill Numbero Taxpayer Nameo Amount Due on the Certificate ofDelinquency as of sale date July 14,2011o Total Amount of all Certificates ofDelinquencyo Total Amount of all Recording Feesfor Certificates of Delinquency
  • The county clerk will make every effort toprevent unfairness in the sale process byprohibiting participation by multiple entities.
  • The sale shall be conducted in a manner similarto a professional sport’s draft with each purchaserhaving an opportunity to purchase certificates inturn through several rounds.
  • The order of selection shall be determined by arandom drawing with the purchaser drawing thelowest number going first.
  • Purchase rounds shall continue until allcertificates have been sold or all purchasers havewithdrawn from the sale.
  • When a purchaser withdraws from the sale, noother purchaser may take the place of thewithdrawing purchaser.
  • Purchasers shall only be allowed to purchasethose certificates included on their previouslysubmitted list.
  • If certificates remain after all purchasers havewithdrawn, then those remaining certificates maybe sold to any registered purchaser.
  • The county clerk may impose a time limit onpurchasers during each round
  • The county clerk shall determine how manycertificates may be purchased in each roundbased on the following guidelines:o 500 or fewer certificates will be soldin lots of up to 5o 501-1000 will be sold in lots of up to10
  • It is the responsibility of each purchaser to dotheir own research on Certificates of Delinquencythey intend to purchase. The Bullitt CountyClerk’s Office will not do research for anypurchaser. It is the purchaser’s responsibility todo bankruptcy research as well.
  • All purchasers are final. No refunds will beissued after the sale.
  • Please contact the Bullitt County Attorney’s Office for any pending litigation or paymentagreements that may be in place.
